Accepted Identification for Notarization — And When a Witness Can Help
One of the most common questions we get is simple:
“What ID do I need for notarization?”
It seems straightforward, but identification is one of the most critical parts of the notarial process. Without proper ID, a notarization cannot move forward — no matter how urgent the situation may be.
Let’s break it down clearly.
Primary Requirement: Valid Identification
For a notarization to take place, the notary must be able to properly identify the signer. This is not optional — it’s required by law.
Acceptable identification generally includes:
State-issued driver’s license
State-issued identification card
U.S. passport
Foreign passport (when applicable and acceptable under guidelines)
The key factors:
Must be valid (not expired, in most cases)
Must include a photograph
Must match the name on the document (or reasonably align)
If these conditions aren’t met, the notarization cannot proceed.
Why Identification Matters
Notaries are not just witnesses — we are responsible for verifying identity to prevent:
Fraud
Identity misrepresentation
Unauthorized signatures
If identity cannot be confirmed, the process stops. No exceptions.
When a Witness Can Be Used to Identify a Signer
There are situations where a signer may not have proper identification. In limited cases, a credible identifying witnessmay be used.
This option is not a workaround — it’s a structured alternative with strict requirements.
A credible witness must:
Personally know the signer
Present valid identification to the notary
Swear or affirm the identity of the signer
Be impartial (not involved in the transaction)
Depending on the situation:
One or two witnesses may be required
The witness must be physically present
The notary must be satisfied with the credibility of the witness
This process involves an oath and carries responsibility for everyone involved.
When a Witness Is Not an Option
A credible witness cannot be used if:
The witness is part of the document or benefits from it
The notary is not confident in the witness’s credibility
The situation does not meet legal standards
Proper ID can reasonably be obtained instead
In short: this option is limited and evaluated case by case.
